Copyright

We go to some lengths to persuade clients to send us copyright free work – text, images, photos, etc and by the same token we have to pursue any violation of our own rights. Original web pages can take a long time to create.

Copyright law varies from country to country but the same basic precept exists, viz that the design and content – in the case of a web page, the coding that generates them and the overall layout as well as some of the components in terms of graphics, etc - are protected by national and international law. A web page has the same copyright protection as any other piece of work and is afforded the same intellectual property rights whether or not a copyright notice is appended.

Scotland 2000 hold the copyright to the pages they create and publish unless otherwise stated. Although we are not obliged to, we place a copyright notice at the foot of most pages as a reminder that the pages have a legal ownership.

Although it is often ruled that the complete page is owned by the page designer, we accept that the information supplied to us viz the text and the photographic originals are not ours but rather the client’s; they have spent the time writing the words and taking the images or paying to have them taken professionally. We, however, have spent a long time scanning, digitally enhancing, resizing, and generally creating an appealing photographic image that is created for a particular web page context. Therefore we have rights over the  images as they appear on our pages;  if you wish to use the image you should enquire of the owner of the original whether they will forward to you, the original scan or printed photo.

The layout of our pages in general and in their particulars are also protected.  A long time goes into the designing and building any particular page.

Plagiarisers steal web pages usually by amending a few minor points to claim uniqueness. This of course is entirely ineffective as a way of avoiding an action for interdict, breach of copyright and damages. Pages should be created from an original design and use original components.  Such plagiarism does great damage to the relationship which we build with clients as well as devaluing our own work. As a preliminary to taking proceedings, we will request the hosting company / ISP to remove the offending pages. It is our experience that they will normally comply with such a request as they themselves, having been given notice of the breach of copyright, find themselves in the same position as the plagiarist. We hope that we will not find it necessary to take this course of action.
